Address immediate safety first

If there is immediate danger, call 911 or seek emergency assistance. Consider a private safety plan for children, transportation, medication, identification, money, devices, pets, work, school, and a secure place to go.

Use a safe device when possible, protect account and location access, and preserve threatening communications without alerting the other person. Court filing itself can affect risk and should be coordinated thoughtfully.

Eligibility and relief come from Chapter 50B

North Carolina’s Chapter 50B defines qualifying personal relationships and domestic violence for this civil remedy. A complaint should state specific acts, dates, threats, injuries, fear, weapons, child facts, and the relief requested.

Emergency ex parte relief may be available when statutory requirements are met. Orders can address contact, residence, custody, firearms, property, pets, and other protections authorized by law.

Prepare for service and the return hearing

An ex parte order is temporary and a later hearing can determine whether a longer order is entered. Confirm service, date, courtroom, remote or in-person instructions, language or disability access, witnesses, exhibits, and any related criminal or family case.

Preserve full messages, photographs, medical and police records, 911 information, location records, witness details, prior orders, and a concise chronology. Do not violate or invite violation of an existing order.

Understand enforcement, custody, and expiration

Keep certified copies, provide them where appropriate, and report alleged violations through lawful channels. A protective order and criminal bond conditions may overlap but remain separate orders.

Track custody terms, exchanges, school and childcare communication, firearms requirements, surrender or return procedures, modification, renewal, expiration, and interstate enforcement. Obtain advice before informal changes.
