Alcohol, impairment and driving under North Carolina law

Alcohol concentration is one form of proof; appreciable impairment, timing, behavior and other substances can also matter.

Law status: Reviewed and updated September 4, 2026. North Carolina law changes, and the facts of an individual case matter.

North Carolina has multiple DWI theories

G.S. 20-138.1 permits the State to proceed on appreciable impairment by an impairing substance, an alcohol concentration of 0.08 or more at a relevant time after driving, or any amount of a Schedule I controlled substance or its metabolites in blood or urine. A person can therefore face an impairment theory even when no admissible .08-or-more result exists.

Conversely, appearance and behavior do not replace the need to prove the charged legal theory beyond a reasonable doubt. Driving, operation, place, substance evidence, timing and admissibility all matter.

AbsorptionAlcohol concentration may continue rising after the last drink and after driving.
EliminationAfter absorption, concentration generally falls, but rates vary.
Appreciable impairmentThe State may rely on driving, speech, balance, judgment and other admissible observations.
Mixed substancesAlcohol, medications and controlled substances may be considered together.

Why people with the same drinks can have different results

Body composition, biological sex, food, pace of consumption, drink strength, time, metabolism and health can affect concentration and observable effects. Online drink calculators are rough estimates, not a safe-driving decision tool or a substitute for chemical analysis.

Lower than .08 does not create automatic safety or immunity

A result below .08 may still be used with other evidence to argue appreciable impairment, and separate lower thresholds apply in commercial and under-21 contexts. The safest plan is to separate drinking from driving entirely.

Practical rule: plan a sober driver, rideshare, taxi or overnight stay before drinking begins. Do not use subjective “feeling fine” or a consumer device as permission to drive.

Frequently asked questions

Can someone be convicted with a result below .08?

Potentially, yes, under an appreciable-impairment theory supported by admissible evidence.

Does coffee or a cold shower lower alcohol concentration quickly?

No reliable shortcut replaces time. Those measures do not remove alcohol from the bloodstream.

Can prescribed medication support a DWI charge?

Potentially. The statute addresses impairing substances, and lawful prescription status does not by itself resolve whether driving was impaired.
